These Terms and Conditions (“Terms”) govern your access to and use of the website located at www.lotusww.org, including any pages, forms, donation functions, communications, content, and services made available through the website collectively referred to as the “Website.”

The Website is operated by Lotus Worldwide Foundation, a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the United States Internal Revenue Code (“Lotus WWF,” the “Foundation,” “we,” “us,” or “our”).

By accessing or using the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.

1. Purpose of the Website

The Website provides information about Lotus WWF’s mission, programs, educational initiatives, partnerships, volunteer opportunities, fundraising activities, organizational leadership, and impact.

Information on the Website is provided for general informational, educational, and charitable purposes. Nothing on the Website constitutes legal, financial, tax, medical, educational-placement, or other professional advice.

2. Eligibility and Acceptable Use

You may use the Website only for lawful purposes and in accordance with these Terms.

You agree not to:

Use the Website in violation of any applicable law or regulation.
Attempt to gain unauthorized access to the Website, its systems, or connected networks.

3. Donations

The Website may allow users to make one-time or recurring charitable donations.

By submitting a donation, you represent that:

You are authorized to use the payment method provided.
The information you submit is accurate and complete.
The donation is made voluntarily and from lawful funds.
The transaction does not violate applicable sanctions, anti-money-laundering, or other laws.

Donations may be processed by third-party payment providers. Lotus WWF does not necessarily receive or retain your complete payment-card information. Your transaction may also be subject to the payment provider’s separate terms and privacy practices.

Unless otherwise expressly stated, donations are made in support of Lotus WWF’s overall charitable mission. A donor’s expression of preference regarding the use of a donation is not legally binding unless Lotus WWF expressly accepts the donation as restricted in writing.

If a particular program becomes unavailable, fully funded, impracticable, or no longer aligned with the Foundation’s charitable objectives, Lotus WWF may redirect unrestricted funds, and where legally permitted restricted funds, toward substantially similar charitable purposes.

4. Tax-Deductibility

Lotus WWF is recognized as tax-exempt under Section 501(c)(3) of the United States Internal Revenue Code.

Contributions may be tax-deductible to the extent permitted by applicable law. Tax treatment depends on the donor’s individual circumstances, jurisdiction, and whether the donor receives goods or services in connection with the contribution.

Lotus WWF does not provide tax or legal advice. Donors should consult their own qualified tax adviser regarding the deductibility of any contribution.

Lotus WWF will provide donation acknowledgments or receipts as required by applicable law. Donors are responsible for retaining their receipts and any other documentation required to support a tax deduction.

5. Recurring Donations

When you authorize a recurring donation, you authorize Lotus WWF or its payment provider to charge the selected payment method at the frequency and amount you choose.

You may request cancellation of future recurring charges by contacting us at [email protected] or by using any cancellation feature made available through the payment provider.

Cancellation will apply to future charges and may not reverse a transaction that has already been processed.

6. Donation Refunds

Charitable donations are generally final and non-refundable.

Lotus WWF may consider a refund when:

A donation was made in error.
A duplicate transaction occurred.
An incorrect amount was processed.
A transaction was unauthorized or fraudulent.
A technical error affected the transaction.
Applicable law requires a refund.

Refund requests should be submitted within 30 days of the transaction to [email protected] and should include the donor’s name, donation date, amount, transaction reference, and reason for the request.

Approved refunds will generally be returned to the original payment method. Processing times may depend on the payment provider and financial institution.

Lotus WWF reserves the right to request additional information before approving a refund.

7. Programs, Partnerships and Beneficiary Information

Descriptions of programs, partnerships, expected outcomes, funding goals, beneficiary groups, and future initiatives may include plans or objectives that are subject to change.

References to a potential partner, school, nonprofit, institution, community, or beneficiary do not necessarily mean that a formal partnership, grant, commitment, or endorsement exists unless expressly stated.

Lotus WWF may modify, delay, discontinue, expand, or replace programs based on available funding, partner capacity, local conditions, legal requirements, community needs, safeguarding considerations, and the Foundation’s charitable priorities.

8. Volunteer and Partnership Submissions

Submitting a volunteer, employment, partnership, grant, beneficiary, or general-interest form does not guarantee selection, funding, placement, employment, engagement, or a response.

Lotus WWF may conduct screening, reference checks, background checks, partner assessments, due diligence, or safeguarding reviews where appropriate and legally permitted.

You agree that information submitted through the Website will be accurate and will not infringe the rights of any other person.

9. Children and Minors

Lotus WWF’s charitable mission may support children and young people. However, the Website is intended primarily for donors, parents, guardians, volunteers, partners, educators, and other adults.

The Website is not intended to collect personal information directly from children under 13.

Children under 13 should not submit names, contact information, photographs, applications, stories, or other personal information through the Website. A parent, legal guardian, school, or authorized partner should communicate on the child’s behalf.

If we learn that personal information has been submitted directly by a child under 13 without appropriate authorization, we will take reasonable steps to delete or appropriately restrict the information.

10. Safeguarding and Beneficiary Dignity

Lotus WWF is committed to protecting the dignity, privacy, safety, and well-being of the individuals and communities it serves.

Photographs, videos, testimonials, names, and beneficiary stories may be edited, anonymized, translated, shortened, or presented using pseudonyms to protect privacy and safety.

Users may not download, republish, identify, contact, target, exploit, or otherwise misuse information about any child, student, family, beneficiary, volunteer, or community featured on the Website.

11. Intellectual Property

Unless otherwise stated, the Website and its content—including text, graphics, photographs, videos, logos, designs, documents, icons, and arrangement—are owned by or licensed to Lotus WWF and are protected by applicable intellectual-property laws.

You may view and print limited portions of the Website for personal, noncommercial, informational, or charitable-reference purposes, provided that you do not alter the content or remove copyright, trademark, attribution, or proprietary notices.

No other use is permitted without prior written authorization.

The names “Lotus Worldwide Foundation,” “Lotus WWF,” associated logos, taglines, and other brand elements may not be used without written permission.

12. User-Submitted Content

If you submit a testimonial, photograph, story, suggestion, comment, or other content to Lotus WWF, you represent that:

You have the right and authority to submit it.
The content is accurate to the best of your knowledge.
The content does not violate privacy, intellectual-property, publicity, confidentiality, or other rights.
Any necessary consent from identifiable individuals, parents, guardians, schools, or organizations has been obtained.

Unless otherwise agreed in writing, you grant Lotus WWF a non-exclusive, worldwide, royalty-free license to review, store, reproduce, edit, translate, publish, and use the submitted content for charitable, educational, reporting, fundraising, promotional, and organizational purposes.

Lotus WWF is not required to publish or retain submitted content.

13. Third-Party Services and Links

The Website may contain links to payment processors, social-media platforms, partner organizations, event platforms, newsletters, analytics services, and other third-party websites or services.

Third-party services are operated independently. Lotus WWF does not control and is not responsible for their content, availability, security, privacy practices, terms, or accuracy.

A link does not necessarily constitute endorsement, approval, sponsorship, or affiliation.

You access third-party services at your own discretion and subject to their applicable terms.

14. Website Availability and Accuracy

We seek to keep the Website accurate and available but do not guarantee that:

All information will always be current, complete, or error-free.
The Website will operate without interruption.
Defects will always be corrected immediately.
The Website or its servers will be free from harmful components.
A particular program, event, donation opportunity, partnership, or service will remain available.

18. Governing Law and Jurisdiction

These Terms will be governed by the laws of the State of Washington, without regard to conflict-of-law principles.
